5.1 Principles of Responsible AI

Procedure for Prohibited Use Requests:
Any business request that may implicate a prohibited use must be escalated immediately to the CDO and CLO. A written determination will be issued within 10 business days. No work may proceed pending determination.
5.4 AI Training Data Standards
5.4.1 Consent and Legal Basis
- Training data containing personal data must have a documented lawful basis (not assumed)
- Where consent was the original basis, it must expressly cover use for AI training
- Legitimate interests assessments (LIAs) must specifically address AI training as a use case
- Web scraping for training data requires legal review and must respect robots.txt, terms of service, and applicable law
5.4.2 Dataset Documentation (Model Cards / Dataset Cards)
Required for all AI training datasets:
- Provenance: Where did the data originate?
- Collection Method: How was it gathered?
- Legal Basis: What authorizes its use for training?
- Data Subject Coverage: Who does it represent? What demographics?
- Known Limitations and Biases: What gaps or skews exist?
- Processing Applied: Cleaning, augmentation, synthesis steps

5.4.3 Synthetic Data
- Synthetic data generated from personal data inherits the classification of the source data until re-identification risk is formally assessed
- Re-identification risk assessments must use quantitative privacy metrics (e.g., k-anonymity, differential privacy parameters)
- Approved synthetic data may be downgraded in classification; the re-identification assessment must be retained permanently
5.4.4 Data Minimization in AI

- Inputting Tier 3 or Tier 4 data into any AI tool not approved for that classification level
- Inputting personal data of colleagues, customers, or third parties into consumer AI tools (e.g., public chatbot interfaces)
- Using AI to circumvent access controls or security measures
- Representing AI-generated work product as exclusively human-produced in contexts where that distinction is material (legal documents, regulatory submissions)
- Using AI tools to make consequential decisions about individuals without human review
5.8.3 AI Use Disclosure
Employees must disclose AI tool usage when:
- Generating content for external publication or regulatory submission
- Creating legal documents, contracts, or compliance certifications
- Producing research or analysis presented as expert opinion
5.8.4 Shadow AI Prevention
- Network DLP controls will detect and block unauthorized uploads of classified data to AI endpoints
- Periodic scanning for unauthorized AI tool usage on corporate networks and endpoints
- Violations treated as data security incidents with disciplinary consequences per Section 14
SECTION 6: CROSS-BORDER DATA TRANSFER CONTROLS
6.1 Transfer Impact Assessment (TIA) Framework
Before any personal data transfer to a third country (country without an adequacy determination for relevant jurisdiction), a Transfer Impact Assessment is required for Tier 3-4 data. The TIA evaluates:
- Legal Framework Analysis: Does the destination country have surveillance laws that override contractual protections? (Reference: Schrems II CJEU ruling)
